Umphakathi Recruitment (Pty) Ltd will process your data.
On what legal basis we process data?
The data will be stored on the basis of the permission that you send us when you enter the program. The data you have on third parties will be processed on the grounds of genuine interest.
Type of data we collect
We gather information that you willingly send to us. We also keep records of any customer care requests that you may have, as well as your visits to our sites, including IP addresses, site logs of your activities and messages that you send.
How will your data be used?
UMPHAKATHI RECRUITMENT (PTY) LTD just uses your data to allow us to deliver the service. Your data will never be revealed or marketed to any third party until you give that permission directly. The third party data generated by you as one of the ‘Tell a Buddy’ or ‘Recommendation’ functionality can only be used to provide such features.
How long is data kept?
We will retain your personal details as long as you or we uninstall your profile. When removed, it will be archived for another 3 years and then completely deleted.
UMPHAKATHI RECRUITMENT (PTY) LTD works aggressively to secure the confidentiality of your personal data. In addition to the encryption that we extend to our core technologies, your data is encrypted during transmission over the Internet. Your password is not saved in plain text to help protect your protection. Your password is hashed using a one-way hashing algorithm, which means that it cannot be retrieved (or disclosed) by anybody, even ourselves, but can only be reset. In order to preserve the security of your personal data, you must keep your password private at all times.
We gather information that you willingly provide to us when you build and complete your profile, including publicly identifiable information such as your name and email address. This information is kept on our servers, but no personal contact information will ever appear on your public profile or be used in any correspondence that we might send to other members.
If you want to pay for the Facilities by card, you will be asked to provide additional information about your payment card number. This details will be forwarded to our payment processor through a secure connection and your card number will not be identified or kept by us at any time.
We also retain records of your visits to our service, including, but not limited to, IP addresses, web logs of your operations, other link information, including the URL of any service from which you have accessed the service. We also maintain information of all communications you send and receive through the services, as well as archives of your member assistance requests and communication in the event that you contact us. As for most Internet-based services, we also use small files that we save on your computer called cookies.
Any such data shall be referred to as personal data.
Personal data shall be collected on the basis of one or more of the following:
- You give us your permission when you enter the service. If you wish to revoke your permission, please uninstall your profile as we are unable to deliver the service without your continuing approval.
- If you supply us with personal data about a third party (for example, by using the ‘Tell a Buddy’ or ‘Recommend’ features), you warrant that you have received the express consent of a third party for the publication and use of your personal data. We will then process their data on the grounds of genuine interest to ensure that we only use it to deliver the service required by you.
Control and disclosure of personal data
Until you give us your clear permission to do so (by checking the box or otherwise), neither we nor anybody else to whom we provide your personal data with your consent will:
- Disclose all of your records without your consent.
- To offer or rent or to send your details to some third party.
- Disclose your details unless we are needed to do so by statute or policy.
How we use personal and other data?
- For us to process your personal data (including any confidential personal data such as your sexual orientation) for the purposes of delivering the Services and for any other purposes for which you have given your express consent.
We can also use the knowledge to help us assess the use of the Services and to develop the Services and their content or to solve issues and to enforce the Words. Your personal details will only be accessed by authorised personnel (or by such third parties as we may use from time to time to store and process data for us).
Updating user information
You should keep the service records up to date. You can, at any time, update all your personal information, including username, email address, venue, password, consent and all profile details.
You can access your account information and our service only by using your username and password. In order to maintain the security of your personal details, you must keep your password secret and not reveal it to any other user. Since it is not saved in plain text, the password is hashed using a one-way hashing algorithm, which means that it cannot be retrieved (or disclosed) by anybody, even ourselves, it can only be reset. Please contact us promptly if you feel that your password has been misused.
Please note that we will never ask you to share your password.
We can give you a cookie when you visit the service. A cookie is a small file that can be saved on your computer’s hard disk for record keeping purposes, and we can use it to do a variety of things:
- Cookies help us recognize you when you visit the service next time and take note of any advertisements displayed to you. This allows us to tailor our advertisements to your preferences. For this purpose, we may use the services of third party ad servers.
- Cookies may be used to compile anonymous statistics related to the uptake or use of services or browsing patterns. A third party collects such data on our behalf in order to measure the performance of our services. The information collected shall be aggregated for reporting purposes.
Cookies cannot be used by themselves to mark you. You are not required to accept cookies and will change your browser so that it will not accept cookies. If you customize your browser to reject cookies, you can use some, but not all, parts of the service. For e.g., the login method and all member features require your browser to allow cookies.
If you choose to disable third-party cookies created by advertisers, suppliers of personalized ads or behavioural analysis services, you may toggle them off by going to the third-party service and asking them to create a one-time “no thanks” cookie that will avoid any more cookies being written to your computer.
We can also track IP addresses. The IP address is a number that can identify the Internet Service Provider, the location of the country, etc. It is unable to provide sensitive details. We will not use the IP address to create a user profile, we will only use the details for demographic, statistical and security purposes.
Data retention and deletion
You have the opportunity, at any time, to cover your profile from the public view in connection with the Services. You can also permanently erase your profile anytime you want, as mentioned below.
As long as you remain a Participant or a Subscriber (i.e. your profile has not been removed either by you or by us), it is your duty to either uninstall your profile or allow us to do so if you no longer want to use the Services. If we can no longer reach you via your email address, we reserve the right to uninstall your profile without further notice. In addition, if you do not log in to your profile for 5 years, we will presume that you no longer want to use the service and that it will be removed.
Please note that we will retain your personal data (together with any third-party data you provide under the ‘Recommendation’ feature) until your profile has been deleted. It will then be archived (including any photographs that you may have uploaded) for a period of 3 years from the date of deletion at which time it will be deleted.
For a period of 12 months, personal details given as part of the ‘Tell a Buddy’ feature will be kept. Unless we are required by law to do so, it will never be used for any other purpose, nor will it be shared with or given to any third party.
For a maximum of 6 months from the date sent, personal correspondence sent to other members through the service will be archived, then deleted.
Any correspondence or member support enquiries sent through the in-built member support system will be kept for a maximum of 5 years from the date the support thread is closed in order to allow us to respond to any queries or complaints you may subsequently have.
How to delete a profile?
Go to the My Account page of your profile and click on the ‘Delete My Profile’ icon.
NB: If you are a subscriber and have time left on your subscription, it will be deleted with your records and will only be refunded in accordance with our Refund Policy. We recommend that you actually cover your profile if you are not clear about this.
We are not going to send spam emails to you. You will receive important service-related emails from us while you are a member or subscriber, and you can receive emails from other users via the service. Most of these emails can be managed via the settings page on your profile, but if you want to opt out of all our service emails, you need to uninstall your profile.
We will never supply, sell or rent your email address to any third party, and unless you specifically accept that we should do so.
The ‘tell a buddy’ and ‘recommendation’ functions are included in our service. Your friends will never get emails from us that are unsolicited. When the email ‘tell a mate’ is received, whether they want to become members themselves, they will not hear from us again. You cannot use services such as ‘tell a buddy’ to send spam. If you use the ‘Recommendation’ option, then if you direct us to do so, for example by pressing the ‘Send Alert’ button, your friend will only receive an email from us.
UMPHAKATHI RECRUITMENT (PTY) LTD runs a service network. The profiles can be shared with related resources across this network. Therefore, you will also be able to see profiles from any of our other sites and vice versa, in addition to seeing profiles from the program you enter.
Signing up with Social Accounts
For members to enter or log in with a social network account, we have a fast and simple process, e.g. From Facebook. This is for the main purpose of speeding up the process of entering, and no connections to the account or timeline for the social network will be posted. For times when you can have consent to share information on your social network site or timeline, refer to the ‘Social Network Sharing’ portion.
Sharing Social Network
Our members and program visitors have the ability to post a profile on social networks like Facebook, Twitter, etc. that they like with their mates. We would never reveal any personal information submitted by users that is not publicly posted on the profile of the user.
UMPHAKATHI RECRUITMENT (PTY) LTD is committed to safeguarding the privacy of your confidential information. Nevertheless, while we take appropriate steps to secure the sensitive information we gather, no surveillance device is impenetrable.
We have a range of precautionary mechanisms in place to help deter the damage, theft, misuse and improper entry, publication, modification and degradation of information about you. For e.g., on computer systems that have restricted access and that are in managed facilities, we store the personal data you have. We also ensure that our third-party data centre providers provide me with sufficient protection.
We are legally bound to alert the authorities within 72 hours in the case of a security violation and will try to respond as soon as possible to address the matter. However, we cannot take liability for Member data that is lost or breached in the case of a security breach.
You have the right to object to the use of your personal data by us, or to ask us to delete, remove or stop using your personal data if we do not need to retain it. This is referred to as your right to be forgotten.
By editing your profile, you can view, edit or delete your personal data. You also have the right, by ticking the appropriate boxes on the settings page of your profile, to ask us not to process your personal data for marketing purposes.
